admitted to purchasing VCR and camcorder from a stranger he met on the street for $75. Gilbert pled guilty but then appealed

claiming ineffective assistance of counsel because his attorney did not ask the judge to waive prior strikes under the 3-strikes

law. Gilbert then lost on appeal. Probation report had recommended 3 years.
