3-Strike Stories: James Allen Mar
Name and Family History:
James Allen Mar. Mother and father deceased. All family and relatives reside out of
state.
Strikes:
1st strike - Teller window robbery at bank as a youth (A note) 1982.
2nd strike - ADW on police officer (vehicular) attempting to get away, 1988.
3rd strike - Resisting arrest (turned myself in for a parole violation) 1997.
Story:
On September 2, 1996, I had someone contact 911 emergency officers to help me go into
custody because I was in violation of parole and had accidentally discovered a
surveillance operation being conducted by police and law enforcement in the city of Taft,
CA. I was fearful of my discovery and didnt want to be set up or charged with any
crime other than the parole violation for failing to report on the scheduled day. I
voluntarily went into custody without handcuffs, was in jail for 1½ hours pleading for my
right to a phone call in order to call my parole officer and girlfriend to let them know I
was in jail. My requests were denied which led to an incident where I was beaten by jail
officers for demanding my right to call. The officer struck me numerous times in the
skull, fracturing his right knuckle. I was not provided with any medical attention and
later found that a Resisting Arrest charge was placed against me (after I was already in
jail for 1½ hours). I was then maliciously prosecuted and eventually convicted and given
26 years to life for Resisting Arrest charges that were created to excuse the officers
actions against me for standing up for my rights. I have suffered physical and mental
abuse but continue to stand for my constitutional rights.
Comments:
Local courts and District Attorneys are simply abusing the true purpose that the
3-Strike Law was intended. Any person ever convicted of a crime is a potential victim and
will be affected by this law. Jesus said, let he who is without sin, cast the first
stone. Who can stand and say theyve never done anything wrong their whole
life, yet stand idly by and allow this kind of law to stand?
