I've been in the Santa Clara
Co. Dept. of Correction since 1-3-97 under the three strikes law for possession of one
rock of crack cocain and about $10.00 worth of methamphetamine in which I face 52 years to
life. I was approached one evening after work while using the Public phone, searched
without my consent and have been here every since. Since them I have spent many sleepless
nights tossing and turning wondering if the lord will answer my prayers and give me
another chance at life. The one good thing that I have gained from this experience, and
what has kept me sane is the Lord, Jesus Christ as well as a new attitude and outlook on
life. About six months ago, I plead guilty and threw myself at the mercy of the court
without the hopes of getting some mercy. I went to court about a month ago and was told
that the Judge is learning toward not dismissing any strikes because of my past. My
question is, what's the use in throwing myself
at the mercy of the court if there's no chance
of receiving any mercy? My lawyer say's that I
wouldn't be able to withdraw my plea, I'd have to have a good reason. Do you have any input
or knowledge on this type of a situation would greatly appreciate any and all the
information and assistance that you may be able to give me on this matter?
