3-Strike Stories: Ray Dino Davis
I'm doing 25 years to life for .23 gram of Rock Cocain. Simple
possession. I truly feel this law is unjust... I was caught up in a reverse string
operation where the police claim I bought a $10.00 piece of Rock Cocain from they. I don't
know how the public is allowing the police to bring crack to our street and set up a drug
house in target area of community. But it's a know fact that they are doing this. Nobody
have paid allotion to the fact the police who is there to serve and protect is putting
drugs on the street's for our kids, right under our nose, I now admit I had a drug problem
which I fet was out of hand at the time before my arrest. I support my drug habit by
working. I never committed a crime to support my drug habit, due to my job related injury
and the pain I used crack to ease my suffering. Befor my arrest I worked for Frito Lay in
Ranch Cucanorga as a forklift driver making $11.55 hrs. I supported my family.. due to me
being in prison I lost my house and my wife is now on welfare. My kids have never been on
welfare before and it sadden me because I taught my kids to be responsable. I no longer
can set an example for my daughters, my prion record in which the court used to give me a
3 strikes is dated back to a 1983 conviction of Robbery and a 1984 Kidnape, at the time of
these crime I was 18 years old and found myself running with the wrong crowd. I got out of
prison in 1986, by 1987 I sucessfully completed my parole. Before this drug case my runin
with the law was for possession of marijuara. No other convictions. I don't see how a
judge in his right mind can reach back 12 ot 13 years ago and justify giving a human being
25 years to life for a drug habit. I never been in a drug program, nor did the judge
Robert Law of San Bernandino even consider a drug program for me. Alot of people was
fooled by this law Three Strike and last year the higher court fooled the public again by
killin them the Romero case will help alot of prisoner who sentence was unjust...Romero
issue was for Ramero only and to blind the public and mislead them in to believing they
fix the law to target violent crimal. I for one know for sure because I have been denied
to get resentence by the court of appeal and the supreme court under the Romero decision.
They reason is because I have a "silent record." Which means no discretion was
use, so therefore I'll never get a chance to get in front of the sentencing judge who have
the discretion to strike a strike.
