3-Strike Stories: Daniel Dugan

My name is Daniel Dugan. I am presently serving a sentence of 25 years to life under Calif 3 strike law for the offence of petty theft w/ prior. Stealing $72.26 in Aspirin. I was convicted in LA County case #B-09602.

While waiting in the holding cell, awaiting sentencing, another inmate's lawyer informed him the district atty was offering him a 5 year deal. As his crime was also petty theft w/ prior (taking a 12 pk of beer). When I saw my atty I inquired about this she state, " I know. He also has a prior for a lewd and lacivious act upon a child. "Unfortunatly you have more misdemeanors." My 2 strikes are a 1980 burglary and a 1990 burglary. I have zero violence, nor any type of sexual unlawful behavior in my past upon sentencing, I presented to the judge, a letter of acceptance from The Delancy Street Foundation. This is a 24 hour-2 year minimum drug and alcohol rehabilitation program. They stated I certainly qualify and that they feel they could help me. Upon sentencing, the judge said nothing on the letter, but stated although I have no violence, I am a recidivist and I then received a 25-life sentence.

I do acknowledge I have many arrests. But they are all misdemeanors behind a lengthy abuse of drugs and alcohol. I have 17 years to go before a parole hearing. Tax payers foot the bill for every day of it. I can and have been productive in society before. I need help with my addiction. There's not so much as an A.A. Meeting where I am.
